This individual will lead and direct the group responsible for defending a claim or lawsuit on behalf of MidAmerican Energy Company or other subsidiaries as requested for property and bodily injury claims brought against the company by external parties (customers, contractors, vendors, insurance companies). Will lead and guide staff regarding the extent of liability of each party involved by applying electric and gas tariffs, state and local ordinances, contract language, legal principles and gas and electric technical knowledge to determine the proximate cause of the damage or bodily injury, all using effective communication, negotiation, analytic skills and comparative fault analysis to accept or defend the claim or lawsuit and protect the company assets.Will also be responsible for risk management analyst responsibilities within the MidAmerican Energy Holdings Company corporate risk program. This may include assisting in the planning, directing and coordination of corporate risk programs including insurance procurement; conducting various analyses on insurance programs; monitoring policy changes and endorsements; participating in risk management plan business risk audit reviews; assist in the development and analysis of corporate enterprise risk management plans and acting as a backup to the director, risk and insurance management.This position provides assistance to the group responsible for the management of property damage claims presented by MidAmerican Energy Company or other subsidiaries, against third parties damaging company property. Also assists the director, risk and insurance management for corporate insurance program and department budget preparation and allocations across MidAmerican Energy Holdings Company businesses. Primary Job Duties and Responsibilities (Essential Job Functions):
Manage the department that defends property, auto and bodily injury claims brought against MidAmerican Energy and other subsidiaries as requested. Will train and develop staff in procedures of acquiring all facts and evidence surrounding the claim or lawsuit; interview the claimant-supervisor-employee-company technical representatives, local and state officials and analyze the data acquired to determine the extent of legal liability. May employ outside experts to acquire additional technical opinions to defend the claim. Will apply the provisions of company procedures, contract language, state and local ordinances, utility tariffs, case law and other legal principles to defend company position. Calculate claim liability reserves in the process of mediating favorable resolutions with claimants, claimant attorneys and insurance companies to resolve the claim or lawsuit and protecting company assets.Assist in the design and/or coordination of the development of insurance specifications and coverage to protect the company against catastrophic loss exposures. Help determine and select appropriate insurance programs and markets and negotiate insurance coverage placed on behalf of the company. Assist in the management of the use of insurance brokers and consultants where needed for placement of insurance and risk management programs. Provide information necessary for notice, coordination and settlement of major property and casualty losses recoverable from the company's insurance carriers. Provide data to assist in the development of strategic and operational plans for control, management and improvement of insurance capabilities and for ensuring alignment with company goals and objectives. Participate in the development of the corporate and departmental business plans.Manage the department that resolves third-party damage claims presented by MidAmerican Energy Company and other subsidiaries as requested to recover company assets involved in the damage to company property by other parties. Will train and develop staff in procedures of acquiring facts of the damage and repair through interviews with responding crew, crew supervisor, company technical representatives, local and state officials and subcontractors. May analyze data acquired to determine the extent of liability of the third party; applies the provisions of company procedures, contract language, state and local ordinances, utility tariffs, case law and other legal principles with the responsible party, their attorney or insurance carriers to resolve the claim and recover company assets.Will lead and develop staff in investigating the causation of electric contacts to company employees and the general public and provide management and staff attorney with the results of the investigation. Initiate phone contact with utilities board to report the extent and cause of the electrical contact and provide agency with a written report at the completion of the investigation.Provide technical skills and training to the claims staff, delivery services personnel to protect company from claims or lawsuits. Develop and recommend enhancement and action plan to the claims procedure, claim administration, ensuring claim files are properly managed and procedures are adhered.Report to staff attorney, company managers and vice presidents on the extent of liability on property and auto damage, bodily injuries to third parties and company damage claims. Work closely with staff attorney and outside counsel on all litigated cases, responding to the request for production of information and answering of interrogatories.Apply technical knowledge to investigate and manage all aspects of company workers' compensation claims when a third party is involved. Initiate skills in determining arising out of and in the course of employment to accept or defend a work injury claim. Pursue the third party to recover company property assets involved in the injury.Provide supervision and give direction to department staff, company personnel on behalf of claims management team and company attorney in the process of claims management, gathering claim information and providing oral and written responses.Perform administrative activities necessary for the effective management of the department, including employee safety, selection and development of employees, safety administration, budget administration, employee counseling and motivation, organization goals and objectives and planning, organizing, integrating, measuring and reporting the work performed within the department.Perform any additional responsibilities as requested or assigned.

REQUIREMENTS
Bachelor’s degree in business or related field or equivalent related work experience. (Typically six years of related, progressive work experience would be needed for candidates applying for this position who do not possess a bachelor’s degree.)Five years experience in insurance or claims management, including one year in a senior technical/leadership role.Associate in claims or associate in risk management certification.Strong communication (both oral and written), investigation and negotiation skills in corresponding with customers, claimants, insurance carriers and attorneys on claim issues. This is important for billing issues and when communicating the denial of a claim.Microsoft Office skills to create and/or maintain spreadsheets and databases to monitor and report on the status of claims and overall department claims processing activities.Effective analytical and problem-solving skills.Ability to prioritize and handle multiple tasks and projects concurrently.Ability to travel within the service territory for company meetings and occasional overnight stays for training.~hj~
