Assist the liability manager in the investigation and processing of general liability claims in accordance with established company guidelines. Ensure that all general liability claims are effectively processed in a timely, cost effective manner.MAJOR JOB RESPONSIBILITIES:
Handle a variety of moderate to severe general liability claims
Conduct an initial review and investigation of customer accidents by contacting customers, store associates, witnesses and vendors
Obtain appropriate documentation from the claimants or their attorney, store associates, and medical providers to properly evaluate the claim and to assist with establishing and maintaining accurate reserves
Promptly respond to calls from customers, store associates and division office personnel
Negotiate settlement with customers or attorneys on general liability claims up to $20,000 settlement authority including litigated cases
Review appropriate leases and contracts in order to pursue indemnification or tender of defense.
Search for ways to improve claim handling making recommendations to the liability manager for continued improvement of company policies for processing general liability claims.
Advise management of potential areas of improvement for loss control.
Develop and maintain effective working relationship with manager, supervisor and peers with open communication of ideas
Seek alternative solutions to problems
Analyze appropriate data and make sound decisions while proactively resolving claims
Attend mandatory settlement conferences, mediations, arbitrations and trials as necessaryQUANTITATIVE/SCOPE MEASUREMENT/ACCOUNTABILITIES:
Settlement authority up to $20,000
Maintain average monthly caseload
Number of openings, closing and pending
Expenses incurred in the use of outside vendorsKNOWLEDGE, SKILLS, & ABILITIES:
High school diploma required, Bachelors degree preferred. Prior experience as Liability Adjuster I within the company or minimum of 5 years experience handling general liability claims
All Lines Adjuster License * (In applicable states)
Exhibit excellent communication skills, both oral and written.
Demonstrate excellent public relation skills with the ability to work with and through others, for example; defense attorneys and independent adjusters, to achieve desired result
Must have excellent empathic skills and the ability to deal with conflict
Ability to organize and prioritize workload is essential
Computer skills to include letter writing, software applications and accurate typing ability required
Must be able to handle confidential information in a mature and professional manner while using sound judgment and discretion in processing claimsWORKING CONDITIONS AND PHYSICAL DEMANDS
Work is performed under normal office conditions in a temperature-controlled environment.
Will spend majority of the workday sitting at a desk or computer terminal or walking within a limited area.
Will use computer, keyboard, telephone, calculator and other office equipment.
Travel will be required within the assigned area to attend selected trials, ADRs or for store investigationSUPERVISORY AND MANAGERIAL:
When approved by management, assign independent adjusters and supervise their performance with emphasis on proper claim handling and aggressive cost control
