1031 Exchange Counsel
1031 Exchange Counsel Responsibilities Provide legal support, analysis and counsel for LandAmerica Exchange Company (LEC), its administrators, officers and customers
Oversee, review and maintain all forms used by LEC.
Develop and issue procedural guidelines for the correct use of all forms.
Interface with Treasury Department on 1031 exchange policies and procedures
Review and rewrite as necessary as well as maintain the policy, forms, and LEC Reverse Exchange manual, ensuring legal compliance
Conduct legal training seminars for internal personnel as well as for customers
Issue underwriting directives to other 1031 Exchange offices and personnel
Remain abreast of current changes in exchange laws, rules and regulations and advise offices and personnel accordingly
Refer claims and other complex legal matters to the Corporate Legal Department and assists in the resolution of those matters
Write articles for trade and legal publications yearly
Conduct training seminars for LEC personnel on basic and advanced 1031 Exchange issues
Serve as a resource and speaks at outside seminars including bar associations, commercial trade organizations and customer offices
Oversee maintenance and updates on Order Management System (OMS) for 1031 Exchange offices
Create and maintain online 1031 training course for LandAmerica employees
Responsible for production of Channel 1031, the LEC newsletter
Minimum Qualifications
Extensive knowledge of 1031 Exchange laws, regulations, processes and procedures
Extensive experience in the 1031 Exchange industry
Overall knowledge of commercial real estate-related legal issues and technicalities
Exceptional public speaking and writing skills.
Ability to operate general Microsoft Office suite software and computer peripherals
Juris Doctor with at least five (5) years of progressive experience in real-estate law with special emphasis on 1031 Exchange laws
Preferred Qualifications
Customer service or marketing experience
Knowledge of commercial trade organizations, potential customer bases and ability to integrate and relay accurate information in a timely manner
